Second Lava Lawsuit Filed Against Lloyd’s of London

The second lawsuit against Lloyd’s of London, filed by attorney Jeffrey Foster, highlights a troubling trend of denied claims in the aftermath of the Kīlauea Volcano eruption. Despite Lloyd’s confirming in writing that a home was a “total loss,” the insurer denied the homeowner the benefits they had paid for with their premiums. This denial, like the Haysmers’ case, came from a claims adjuster in Little Rock, Arkansas, who had likely not inspected the property personally.
Foster’s pleading points out that, due to a mandatory evacuation order, it is doubtful that the property had been inspected at all. This raises concerns about the thoroughness and fairness of Lloyd’s investigation process, especially considering the adjuster had not visited Hawaii.
The lawsuit accuses Lloyd’s of breach of contract, deceptive business practices, bad faith, and conspiracy. Foster emphasizes that many Puna residents are facing similar mistreatment or neglect from Lloyd’s and that he is committed to fighting for their rights. The lawsuit underscores the importance of holding insurers accountable for their obligations to policyholders, especially in times of natural disasters.
