11 More Puna Homeowners Sue Lloyd’s of London

HILO, Hawaii, May 6, 2019 (Big Island Now) — In January 2019, Leilani Estates homeowner Howard Konanui Sr. and 10 other Lloyd’s of London policyholders, joined by dozens of others, filed lawsuits against Lloyd’s and its affiliates. These lawsuits were in response to delays, denials, and dismissiveness regarding claims for homes damaged during the Kīlauea eruption.
Konanui owned two adjacent homes in Leilani Estates, both suffering significant damage. One was insured by the Hawai‘i Property Insurance Association (HPIA), which promptly paid out hundreds of thousands of dollars after determining the home was a total loss. However, Lloyd’s of London, insuring the other home, offered Konanui only $8,880.89 for his claim, despite similar damage to both properties. Lloyd’s refused to declare the second home a total loss, leading Konanui to spend months corresponding with Lloyd’s claims adjusters and hiring contractors to assess the damage.
Facing this treatment, Konanui turned to Attorney Jeffrey E. Foster and joined other homeowners in a lawsuit against Lloyd’s. Foster noted the stark difference in treatment between HPIA and Lloyd’s, highlighting Konanui’s case as emblematic of Lloyd’s claims handling practices.
The lawsuit, filed by Foster on behalf of the homeowners, alleges breach of contract, bad faith, conspiracy, and deceptive practices by Lloyd’s and its affiliates. It sheds light on the struggles faced by homeowners, who not only receive inadequate settlement offers but also endure lengthy waits and extensive correspondence to explain their claims.
Konanui’s case illustrates the challenges faced by those insured by Lloyd’s of London, pushing them to seek legal recourse. Foster, representing over 50 clients in similar claims, emphasized the need for homeowners to turn to the courts for help against Lloyd’s practices.
