Judge denies insurance company’s bid to dismiss lava victims’ suit

HILO (HawaiiNewsNow) – In a recent development, a Big Island judge has denied an insurance company’s motion to dismiss a lawsuit filed by an elderly couple, Philip and Lanell Haysmer, whose home in Leilani Estates was lost during the Kilauea eruptions. The couple, both in their seventies, had been paying $3,000 a year for insurance with Lloyd’s of London. However, their claims were denied without an adjuster visiting their property, according to their attorney, Jeffrey Foster.
Foster stated that the Haysmers are among a dozen homeowners whose claims were denied. He expressed that after seven months of receiving bad news, it was a positive development to deliver some good news to the Haysmers. The denial of the insurance company’s motion to dismiss signifies that the lawsuit will proceed, allowing the Haysmers and their attorney to pursue their case against Lloyd’s of London.
