Records: ER staff suspected abuse in death of 3-year-old foster child

KAMUELA, HAWAII (HawaiiNewsNow) – Fabian Garcia, a 3-year-old boy in foster care, died last year in July, with the cause determined to be blunt force trauma to the head. Despite suspicions of abuse, the medical examiner did not definitively rule the death as murder. Attorney Jeffrey Foster, representing Fabian’s biological parents, is urging anyone with information about the toddler’s death to contact the police.
Hospital records reveal that emergency room staff suspected abuse in Fabian’s case. His body showed extensive injuries, prompting Foster to express shock at the severity of the damage. Concerns about mistreatment were raised by Fabian’s biological parents, who noticed a bruise on his forehead during a supervised visit shortly before his death.
Fabian’s foster parents found him unconscious in bed, leading to his ER admission. However, details about the foster family and any prior complaints against them remain undisclosed by the state Department of Human Services due to privacy laws.
Foster is urging anyone with knowledge about Fabian’s living situation or his case to come forward. Despite wanting to share their story, Fabian’s parents have been advised by a family court judge not to speak publicly. After Fabian’s death, his siblings were returned to his parents by the state.
