Court finds double DUI suspect guilty, hands down 5-year sentence

KEALAKEKUA — Nicholas Martin, accused of driving drunk twice within 24 hours and striking a pedestrian, Robert LaMarca, was found guilty by a 3rd Circuit Court judge and sentenced to five years incarceration, despite a no contest plea. The incidents occurred on Nov. 30 and Dec. 1, 2017, in Kailua-Kona, with Martin’s blood alcohol content level measured at more than double the legal limit on both occasions.
LaMarca, who suffered critical injuries, addressed the court during Martin’s sentencing, highlighting the impact of the accident on his life, including physical impairments and ongoing medical issues. He expressed disappointment in not receiving an apology from Martin or his attorney, emphasizing the broader safety implications of drunk driving.
Martin apologized to LaMarca and attributed his actions to personal struggles, including the recent death of his father. Judge Melvin Fujino emphasized the seriousness of Martin’s offenses, noting that despite the DUI arrest being a potential wakeup call, Martin chose to drive drunk again, leading to life-changing consequences for LaMarca.
Martin pleaded no contest to DUI and first-degree negligent injury, leading to a five-year jail sentence with credit for time served. LaMarca expressed satisfaction with the sentence, hoping it would serve as a deterrent for others considering drunk driving. Martin’s counsel, Brian De Lima, acknowledged the tragedy of LaMarca’s injuries and stated that Martin had engaged in substance abuse programs and treatments since the accident.
A civil case related to the incident is pending, with restitution to be determined. Jeffrey Foster, LaMarca’s attorney, refrained from commenting, noting the early stage of the litigation process. The case underscores the severe consequences of drunk driving and the importance of accountability and safety on the roads.
